Free Living Will Document Online
As an estate planning attorney with over fifteen years of experience I strongly recommend against using forms for writing a last will and testament. These forms come in software packages and online websites. These forms are either very restrictive as to what you can include or very confusing.
I am not saying you must have an attorney draft the will for you. In fact I am saying the opposite, you can do it yourself saving hundreds or possibly thousands of dollars if you do a little research to learn what you are doing and draft it yourself.
Instead of depending on forms for writing a last will and testament you can draft your own by including the following information:
o Statement revoking all prior wills and codicils;
o Statement that you are of sound mind;
o Provision to pay debts, taxes, expenses of last illness and administration;
o Specific gifts of property or money;
o A residuary section dividing the remainder of your property not previously given away; and
o Naming executors, trustees and guardians if you have minor children.
You also need to sign the will at the end of the document and have it witnessed by at least two – three disinterested witnesses depending on your state laws
I know this does not give you much to go on but you can use it as your foundation as you do research. I suggest that you find an online E-Course or community education class that will teach you more about what goes into these sections.
Do a little research, get educated and write your own will instead of using forms for writing a last will and testament.
