will a non UK resident entitle to NHS treatment if her husband is a British Citizen that living overseas?
I am a Chinese passport holder. my husband is a British citizen but he was born and raised in Malawi. I was a student in UK for more than 5 years, it was where we met. we have been married for 3 years now and living in Malawi. By the new law, if our baby is born in Malawi, he/she will not be able to apply for a British passport, only Malawian or Chinese. so we are planning to have the baby in UK. I can apply for a 10 year entry visa to UK. but then will i entitle to free NHS treatment when i get there? or will I have to pay all or percentage of the cost to deliver the baby? Will it be complicated for our baby to get a passport when its born? how long will it take? what sorts of documents must i prepare b4 i go there? will the hospital and staff be nice to me if they find out i am not a resident?

Most NHS treatment is not automatically free of charge to other people from abroad. Access to the NHS depends on a combination of one or more of: immigration status; length of residence; nature of the treatment required; and whether the need for it arose during the visit.
However, certain NHS treatment is free to everyone. This includes testing and counselling for HIV or sexually transmitted infections at a genitourinary clinic (but not any subsequent treatment for HIV), family planning services, treatment for mental disorders, hospital accident and emergency treatment (but not in-patient care) and treatment for notifiable diseases and other conditions to which public health laws apply (including tuberculosis, but not including HIV).
In addition, certain categories of people are exempt from any NHS charges. The main categories are: those who have been lawfully living in the UK for the previous twelve months; anyone in legal employment in the UK; anyone taking up permanent residence in the UK (although those applying for permanent residence will be charged until this is granted); refugees and asylum seekers; prisoners and immigration detainees; full-time students; and those whose home countries have a reciprocal health agreement with the UK.
A recent ruling means that refused asylum seekers are also entitled to free NHS treatment and care as long as they remain in the UK.
