Living Will And Testament Template
Can a will be written out on a Piece of Paper that says Last Will and Testament and be Legal?
My Friend has asked me to type up a Last Will and Testament Template for him, so he can fill it out, he doesn’t want to use a Lawyer/Solicitor will it still be a legal document, I told him I think he needs at least 2 witnesses, to see him sign the final paperwork, but not too sure if it has to be seen by a lawyer to be Legal? I live in Scotland UK, Scottish Law and English Law are Different, Please help.
He has no family and very little of an estate as he is on benefits, he’s dying of Cancer and lived in a Caravan, he’s now in a hospice, He’s my Friend and I want whats right for him, everything he has is of Sentimental Value, No Monetry gain at all, and if there was, I Personally would make sure it went to the right Areas or Persons, I just want what’s Best for him. That’s why I want the Legality of the Will checked out.
This is called a holographic will, and you are right – it does generally need witnesses. I have checked Wikipedia and it claims that in Scotland witnesses are not needed; however there is no citation for that and I therefore would not trust it. In the rest of the UK witnesses are needed. You do not need a solicitor, but you do need two adults to sign that they have witnessed the signing.
