If you draft a will, then it will have to go through probate. Probate is the process whereby your local Surrogate’s court distributes your assets to your heirs. Depending on your state, this could be an expensive process.
A living trust is a tool by which you avoid the probate process, and perhaps avoid some taxes. You are the “settlor” of the trust. You specifiy which assets you want to be placed in trust, and for whom. Then you name the trustee (i.e., the person that will manage the assets while they remain in trust.) You can make the trust revocable or irrevocable during your lifetime.
In either case, you must consult an experienced Trusts & Estates attorney. Call up your local bar association, and I’m sure they have some sort of referral service to aid you.
