Living Will Estate California
Probate and Guardian of Estate?
Ok, so this is the situation. My fiancee passed away in April we have a child together. We live in NC but he has real property in California. His estate hands down goes to his daughter (our child) but his sister is trying to apply for guardian of the estate. I have already pettition for Administrator since he died intestate wouldn’t it only make sense that I be the guardian of my child’s estate? Why would she think she has that right… Does she? what is your opinion on this and who do you think will win this claim?
Generally unless it can be proven you are irresponsible or have an ulterior or illegal motive as to regard to the child’s estate, the court will award you the guardianship of the estate
