Is my husband entitled to a portion of the estate?

My husband’s mother died in 1999 and left no will. Now his step-father has died and the house that his mother and step-father shared was sold with most of the mothers belongings still in it. Is my husband entitled to any of the estate? We live in Florida. As a side note when my husband was growing up his step-father did claim him on his income tax forms as a dependant but not his biological children.

Probably not.

When the mother died, all of her belongings went to her husband.

If the stepfather died without a will, all of his belongings (which includes everything he inherited from his wife) will go to his biological children. Step children are not entitled to inherit anything unless they are specifically named in a will.

Although he is not legally entitled to anything, he can and should politely ask for specific items that belonged to his mother. For example, if there items of sentimental value – he should send a polite letter that identifies the item he would like to have and provide a brief explanation of what it would mean to him to have.)
