Can I maintain Florida residency if I live out of state for a year or a bit less?

I’m a highschool senior and I’ve lived in Florida for about 10 years now.
I’m applying to NIU in Illinois and hope to attend there a year.
Can I do that, and then transfer right back here to Florida for the rest of my years without having the Out-of-State tuition costs?
I mean I know all the residency forms say I need to prove 12 months or longer of in-state living for residency… but since I’m a resident at the moment, what if I go to Illinois and pay the out-of-state tuition cost there, never become a resident, and then come back to FL? Will I still be a resident here and qualify for in-state requirements/tuition costs?

I am not sure of the answer to your question; however, the fact that Florida still has out-of-state tuition rates could probably be sucessfully challenged in court. There have already been two circuits which have ruled that out-of-state tuition rates are unconstitutional. Charging different rates for in-state & out-of-state violates the P & I clause of the 14th Amendment (see Saenz v. Roe). So, as long as you establish residency prior to attending, you can sue them for in-state tuition rates.
