Hi there.

I’m a family law lawyer so I know what I’m talking about here.

The first thing a lawyer needs to know is where was the initial court proceedings filed (in the State where you live, where your ex lives or in a third state) and the second thing is who has primary parenting of your daughter (meaning who has the majority of the parenting time with your daughter).

If one of you still lives in the state where the initial court action was filed, then that state still has jurisdiction and you file your action there. If not, then you file in the state where your daughter lives the majority of the time.

In terms of a custody case, it can cost as little as $1,500 or as much as $10,000 depending on how contentious the case will be. Usually, the attorney will charge an intital fee of around $2,000 to get started and bill according to how many hours s/he spends on the case.

In most states, they have a Family Court Services at the Courthouse which is free and will help you file your paperwork. However, given this is a custody matter you want to hire someone who specializes in family law because they will know the current law, know what information is important for the Court to hear and will be able to give your the kind of representation you need in this delicate situation.

Hire an family law attorney, not a service. If you don’t know any, then call the local county bar association and ask for names. You can also “indirectly” ask the family law clerks who they would hire if they needed a family law attorney.

Let me know how it goes.
