dying spouse leaves a boat to the executor of the will which is the sibling. However, the living spouses name is on the title as the only owner. The dying spouse name is not on the title. Can the living spouse keep and sale the boat to cover debts made by the dying spouse. All the other tangeable items to be given to the sibling are in the same condition. Can she over rule the will to help pay off debts with a legal document and lawyer? Can she have a court order not to enact the will’s instructions until all debts are payed? Everything these two spouses did was seperate from seperate bedrooms right down to money account and checking accounts.
All debts has to be paid before the estate is settled. Whatever is left goes to the beneficiaries.
If you live in a community property state, all assets acquired during the marriage (except gifts and inheritances given to one spouse with the exclusion of the other), including the boat is community property.
If not, the boat is hers. You cannot give away what does not belong to you.
