Living Will Living Trust Software
Would this be consdered UPL for a paralegal?
if a friend bought a software package that purports to construct living wills and trusts but does not understand all the terminology and wants you to help fill out the documents for a will and trust. would you assisting him be a violation of UPL? if it would be a violation the why if not then why?
You didn’t like my other response to the sme question, so I’ll try again. It is NOT UPL unless you are giving legal advice. There is no problem in explaining what the terms mean, BUT your friend has to fill out the form without any advice from you, so it would be in your best interest to simply lend your friend your legal dictionary and send her on her way with her possibly legal forms. Unfortuantely, you really can’t advise your friend that the forms may not be adequate because that WOULD constitute UPL. The only “advice” you could give your friend is to suggest that she may wish to seek competent counsel.
