my old apartment complex is asking for remainder of lease after asking that i leave within 30 days?
I was asked to move from my old apartment complex for noise complaints, (3 in 18 months). They gave me 30 days notice which I complied with as I was the one in the wrong. The apartment was left in good condition and I was expecting a check for the security deposit I put down but instead recieved a bill for 6,900 dollars (the remainder of the lease). !!!!!!! Can they really do this????? They ask that I leave then when I do as they ask they act as if I left on my own free will, therefore intentionally breaking the lease which was not the case. If anyone can offer any insight as to what they are able to do and what my rights are in regards to this situation I would appreciate it.
P.S I am a permanent resident in this country, living in NC and have not lived here long (from New Zealand). Very unfamiliar with the tenancy laws over here.
You were the one who was in violation of your lease. Therefore you were being evicted for violating the lease terms. (Had you not left voluntarily, they would have filed in the local courts to have you forcibly removed.) You are liable for the remainder of the lease term OR until they place a new tenant. They must make a “reasonable effort” to secure a suitable tenant and in many jurisdictions the courts have held that 2 months is sufficient time to do so, however local conditions can affect that either way.
