rehabilitation of offenders act?
Ok, I’ve already asked a few questions about this, and I’ve looked online and Just need someone to help me with this.
My husband has a criminal record which he got in Feb 2001, which was for Perverting the course of justice and GBH with Intent.
I read online that under the rehabilitation of offenders act he will be ‘free’ from that criminal record in 5 years (so 2006) as he had probation for those.
Is this true ? Is he now classed as having NO criminal record ? Does he have to mention he has a criminal record in application forms from retail to firefighting or police service ?
or does he still have to admit it ??

and not sure if it matters but this happened when we were living in a different county – Bucks, we now live in yorkshire
If the sentences for the two offences were concurrent then, if probation was imposed, the sentences do become “spent” after 5 years (see link below).
The offences will, of course, always be recorded and, even when spent, will show on an enhanced CRB check. Both the police and fire services require such a check and he will never be employed by them.
It is different in other areas. If a potential employer requires disclosure of all convictions, whether spent or not, then the matters from 2001 must be disclosed. If they are not, and subsequently come to light, your husband can be dismissed on the spot. If the employer does not require disclosure of spent offences, then he does not have to mention them.
