More Baloney bailiffs trying to collect on identity theft "debts."

As many of you know, unfortunately, collectors debt to try to collect fraudulent debts that exist only because of identity theft. Sometimes it can be really persistent. NEVER listen to the advice you give your opinion leans just how payment is made timely, IL NEVER inclined to give the right advice and correct their rights and remedies SU.

Here's an email exchange electronics on the same topic today, and my response:

"Here is my situation … In the year 2003 (I lived in New York at the time) was stolen from my bag with all my personal information. Shortly after several credit lines have been opened in my name. I filed a police report with my service local police and took charge of all known fraudulent accounts.
"This year (2008) have been in contact with a debt collector who had acquired debt that had been obtained fraudulently in my name. According to them, I am obliged to send a notarized letter stating that the debt is not mine, copies of documents proving who was not living at the time of birth of the debt, and a police report.

"I told them Should I get a copy of police report from which was introduced five years ago and I could not find the copy that had already received. The collection agency debt has insisted that I should be able to report police where I live now (Ohio). I called the local police time was informed and more each time I could not file a police report for something that happened in New York. I even spoke with a police officer and explained the situation. He was unable to help.

"So there's a month, I requested a copy the original police report in New York. I called a week ago to check on her because she was not yet arrived. They told me I had an investment of 8 weeks.

"Tonight, I received a call from collection agent again. The woman was very rude to me and when I told him he was still awaiting a report from the police, The report said the police would no longer be valid and that I should go ahead and pay the debt. I told him it was not my debt and I would not pay. Then I hung up.

"So … is this true? The original police report submitted no longer valid and if so what should I do? I have told several people the local police department can not in a single file.

[Reply from Bob Brennan:]

"Debt is complete Bs and tell your name you do not need to pay. You can take your sweet time getting the police report because it has an absolute defense to any action brought against him. However, it should continue to do what I can to get the police report. Perhaps the credit bureaus or other creditors may have saved copies earlier. If she has to wait eight weeks for the NYPD to get it, no rush, really. The lady who said that "a police report is no longer valid" was lying, as debt collectors have been known to do.

"If you can not file a police report with a local agency in Ohio, she can still file a declaration of identity theft with the Federal Trade Commission (www.ftc.gov) and may also have one by the Federal Bureau of Investigation or the Office of the Comptroller of the Currency (OCC). Each of them have the same fact that a police report.

"Does this answer the question? If I were this woman, who had Sound recording to start phone calls to set itself a good example under the Law of Fair Debt Collection Practices. If you want a reference to a Ohio attorney who contacted me. "
