Is there any legal documintation in oklahoma for a fence dispute?
i live in the country in oklahoma and we have lived on our land for 13 years and when we first moved here the land owner of the land next to ours said teh fence was to far on his land but nothing ever happened and now we had a neighbor move in to than land a few years ago and now he has talk to that same landowner and is now trinf to get the fence moved over. if teh fence is moved where he says it should be it will be at our house PLZ HELP ME AND DONT SAY THEY CANT TAKE YOUR LAND OR GET A SURVEYOR OR ANYTHING LIEK THAT ANSWER MY QUESTION ABOUT DOCUMENTATION OR LAWS AND PLZ PROVIDE PROOF IF POSSIBLE
Okay…here is the deal…For a moment, lets assume that the fence is on the neighbor’s property…it may not be, but lets assume that it is…
There is a law called “adverse possession” Under this law, you can claim title to someone else’s property if you have occupied and used it for a period of time without permission from the owner. Every state’s law is different, but in OK, the law is that you have to occupy the land for 15 years uninterupted and not have permission. You’ve lived there for 13 years…that is a good chunk of it. if the fence had been there for 2 years before you moved in, you’re golden. If not, adverse possession probably won’t work for you.
One other hitch…it has to be without the permission of the neighbor. If the neighbor originally gave the previous owner permission to build the fence, adverse possession won’t work. Clearly you don’t have his permission now, but he may have at the time.
I would talk to him and try to get some information as to when the fence was built and whether or not he gave permission at the time. Most likely, he will say that he never gave permission (because he thinks that is the strongest position for himself)…if he does, and the fence has been there for 15 years, you can bring an action for “quiet title”…that’s what it’s called…you’ll most likely need a lawyer for this.
