Sample Letter for Removal of Name from Lease? (Roommate Situation)?

I’m currently living with roommates, our 1-year lease was up in August and at that time one roommate moved out and another moved in to take her place. Now we’re on a month to month lease so no worries on breaking any leases or anything.

Things are good, but I recently got engaged and I’m looking to move in with my fiance. We’ve been looking and found a great place. Our move in date is Dec. 1st, which means I’ll still pay for the entire month of November. They will be staying on the lease of course – but I’ll have to come off of it.

How do I go about getting my name off the lease? I know I have to write a letter to our managing company – does anyone have a sample letter or know where I can find one?

AND how do I tell my roommates? I’ll be giving them more than a 30 day notice (45 days actually) but I can’t help but feel a little bad. Any ideas?

I would talk to your roommates before you talk to the landlord/mgmt company. Your roommates will be angry if they don’t find out about this from you. Do they know that you’re engaged? It’s a good place to start! Tell them that since you’re moving out, they’ve got a couple options: they can have a new roommate, or everyone can move out. At least give them the option before you give the company notice, in case they want out, too.

Even though you’re on a month-to-month, you (whether it’s just you, or everyone) still need to give the required notice (usually 30-90 days) of termination in writing. I’d recommend giving it to them in person or sending it via certified mail. Don’t hesitate to ask them questions before you give notice, and don’t feel bad — they’re a rental community, they understand and won’t take it personally.

If the roommates want to stay, check with the mgmt office to be sure that you’re allowed to switch out a replacement, and find out what that would entail… would the old roommates be required to sign on for another full year?

As for the letter, just be sure to include your name, the current date, the date of termination, your unit number and your new address/phone. Make it clear in the letter whether only you will be leaving, or if everyone will be leaving. Keep it short and to the point; you can take care of the “thank yous” and formalities in person.

Talk to your roommates about the security deposit — if they all agree you caused no damages, the new roommate could “buy” your share of the deposit from you. Otherwise, set up an appointment for a walk-through inspection with someone from the office.
